In the Harvey Weinstein case, a mistrial was declared on a rape charge after a juror refused to continue deliberations. The jury had found Weinstein guilty of one sexual assault count but was still deliberating on a final rape charge.

The panel of jurors, consisting of seven women and five men, deliberated for six days in the six-week trial before one juror declined to continue discussions. This mistrial comes after Weinstein's earlier sex crimes conviction in the state was overturned last year, leading to new charges in September.

The trial was plagued with tensions and the jury foreperson brought concerns to the judge, citing instances of jurors attacking each other and making threatening comments. Ultimately, the foreperson refused to return to the jury room due to fears of being yelled at, prompting the judge to declare a mistrial on the rape charge.

Weinstein's previous conviction for sex crimes in New York was overturned in April 2025 due to a lack of a fair trial. The recent trial was based on the testimony of three women who accused Weinstein of sexual abuse. While he was found guilty of sexually assaulting one of the women, a mistrial was declared on the rape charge brought by another.

This latest development adds to Weinstein's legal troubles, as he is also facing a 16-year sentence for sex crimes in Los Angeles that he has yet to serve.
