Lack of space at the State's main youth detention center led to the release of two Dublin teenagers accused of being armed with a machine gun during a burglary over the weekend. One of the boys, who was released on Saturday night, did not show up for his court hearing today, resulting in a warrant for his arrest.
The 17-year-old boys and two men were denied bail after a judge heard that a 60-year-old man was brutally beaten in front of his family by intruders armed with a machine gun in Shankill, Co Dublin on June 11. All four were charged with aggravated burglary and unlawful possession of a Czechoslovakian-made 9mm Skorpian machine pistol.
Following their District Court appearance, it was revealed that the Oberstown Detention Campus had no space to accommodate the two youths despite the judge's decision. Gardaí held them until their lawyers brought a legal challenge to the High Court, leading to a temporary release on bail with a house arrest order until their next court appearance.
Today, Judge Brendan Toale ordered the arrest of the teenager who did not appear in court. Due to the lack of remand beds available, the co-accused teenager was granted bail pending directions from the Director of Public Prosecutions.
Judge Brendan Toale emphasized the ongoing issue of lack of space in the detention facility, stating that it has been a persistent problem for the courts over the past six months. The teenager, who has not entered a plea, was ordered to adhere to several conditions and will appear in court again in four weeks.
Adult co-defendants Sean Doran, 26, and Gregory Dunne, 60, were remanded in prison custody and are scheduled to appear in court later this week. The gun used in the burglary was reported to be capable of full automatic firing, and the charges carry possible life sentences.
During the bail hearings, it was claimed that the teenagers and adult defendants acted in joint enterprise. The court heard that the teenagers approached the house on an e-bike while the adults arrived in a car. One of the teenagers allegedly pointed the gun at the family through the window before forcing entry into the house.
Witnesses testified that the homeowner was brutally beaten, resulting in serious injuries. The proceedings also revealed that one of the teenagers fled the scene with the gun on an e-bike and was later arrested after crashing on the M50.
Despite the serious nature of the charges, one of the teenagers failed to appear for his court hearing today, prompting a warrant for his arrest. Gardaí responded to a distress call from the family's son during the incident, leading to the arrest of three of the defendants.
