The judge has made a decision regarding Diddy's request for a mistrial in his federal racketeering and sex trafficking trial, and it's not in the music mogul's favor.
During the 20th day of the trial, Judge Arun Subramanian firmly denied Diddy's motion for a mistrial.
Last week, Bryana Bongolan, a friend of Cassie, testified that Diddy had held her over the edge of a 17th-floor balcony at Cassie's Los Angeles apartment in September 2016.
While Cassie had previously stated that she witnessed the incident, text messages between Cassie and Diddy's former chief of staff, Kristina Khorram, presented by Diddy's defense team, raised doubts about Cassie's testimony.
In one of the text messages, Cassie mentioned that she had not actually seen the alleged balcony incident, stating, 'I just found out some crazy s***.'
Diddy's lawyers seized on this inconsistency and filed a motion for a mistrial, accusing prosecutors of presenting false testimony.
They also criticized the prosecutors for showing photos of injuries Bongolan allegedly sustained during the incident, claiming that metadata from the pictures indicated they were taken on a day when Diddy was on the East Coast, not the West Coast.
Although prosecutors have not yet responded to Diddy's motion, they clarified in court that Cassie's text suggested the incident took place around September 29 or 30, 2016.
Judge Subramanian, on Tuesday morning, highlighted that Bongolan had admitted to using drugs, particularly during the time in question, and declined to view her testimony as perjury, stating, 'This happened years ago' and 'Thank God she's sober.'
