During the Senate session acting as an impeachment court, a decision was made on Tuesday evening to send back the articles of impeachment against Vice President Sara Duterte to the House of Representatives without dismissing or terminating them.
The vote resulted in 18 in favor, five against, and zero abstentions.
Senator-judge Ronald "Bato" Dela Rosa initially proposed to dismiss the impeachment case against Sara Duterte, citing a potential violation of the one-year ban on impeachment complaints against an impeachable officer.
After a lengthy debate, Senator-judge Alan Peter Cayetano suggested amending Dela Rosa's motion to return the articles of impeachment to the House of Representatives without dismissal or termination until certain conditions are met:
- The House of Representatives certifies that there is no violation of Article XI, Section 3, paragraph 5 of the Constitution, which restricts multiple impeachment proceedings against the same official within a year, and provides details on the first three impeachment complaints.
- The House of Representatives of the 20th Congress confirms to the Senate its willingness to pursue the impeachment complaint against the Vice President.
As a result of the approved motion, there will be no further prosecution presentation on Wednesday. However, Senate President Vicente Sotto III, as the presiding officer, issued a summons to Sara Duterte, requiring her to submit her responses within 10 days.
The negative votes were cast by Minority Leader Aquilino "Koko" Pimentel III, Deputy Minority Leader Risa Hontiveros, Sen. Grace Poe, Sen. Sherwin Gatchalian, and Sen. Nancy Binay.
Those in favor of the decision included Senate President Pro Tempore Ralph Recto, Sen. Robin Padilla, Sen. Christopher Lawrence "Bong" Go, Senate Majority Leader Francis Tolentino, Sen. Imee Marcos, Sen. Cynthia Villar, Sen. Mark Villar, Sen. Jinggoy Estrada, Sen. JV Ejercito, Sen. Ramon Revilla Jr., Sen. Joel Villanueva, Sen. Lito Lapid, Sen. Alan Peter Cayetano, Sen. Pia Cayetano, Sen. Loren Legarda, Sen. Raffy Tulfo, and Sen. Juan Miguel Zubiri.
