The judge overseeing Harvey Weinstein's criminal case in Manhattan has declared a mistrial on a rape charge, one day after the former Hollywood movie mogul was convicted on a felony sex abuse charge.

The judge presiding over Harvey Weinstein's criminal case in Manhattan has declared a mistrial on a rape charge, just one day after the former Hollywood movie mogul was found guilty of felony sex abuse.

Justice Curtis Farber ended the nearly seven-week trial following the refusal of the jury foreperson to continue deliberations, amidst reported dissension among jurors that had been aired in the courtroom.

Prosecutors have announced their intention to pursue Weinstein for a third time on the charge of third-degree rape, related to his alleged mistreatment of aspiring actress Jessica Mann in 2013.

Despite objections from Weinstein's lawyer Arthur Aidala, Justice Farber stated that the case will proceed to trial and scheduled a hearing for 2 July.

The 73-year-old Weinstein, who had pleaded not guilty, continues to deny assaulting anyone or engaging in non-consensual sex.

For his conviction on a charge of first-degree criminal sexual act, stemming from an alleged assault of former production assistant Miriam Haley in 2006, Weinstein faces a potential sentence of up to 25 years in prison.

He was also acquitted of the same charge related to an alleged assault on 16-year-old aspiring actress Kaja Sokola in 2002.

Weinstein is currently appealing a 2022 rape conviction in California, for which he was sentenced to 16 years in prison.

The downfall of Harvey Weinstein was a catalyst for the #MeToo movement, which empowered women to speak out against sexual misconduct by powerful individuals.

In 2017, Weinstein's downfall began, leading to the emergence of the #MeToo movement and the subsequent wave of allegations from over 100 women.

The mistrial was declared after the jury foreperson reported being shouted at and threatened by other jurors for refusing to change his vote on the rape count. The foreperson did not publicly disclose his intended vote, and jurors were dismissed to allow tensions to ease.

During closing arguments on 3 June, the prosecution highlighted how Weinstein utilized his power and influence to manipulate and harm women, while the defence claimed that the accusers lied out of spite after their consensual encounters with the producer did not lead to Hollywood success.

Weinstein, who has faced numerous health issues in recent years and attended the retrial in a wheelchair, co-founded the Miramax studio known for producing award-winning films such as "Shakespeare in Love" and "Pulp Fiction."

Following widespread allegations of sexual misconduct in late 2017, Weinstein's eponymous film studio filed for bankruptcy in March 2018.
