Dublin Bar Manager Awarded €8,000 for Unfair Dismissal

A bar manager who denied accusations that he was "defrauding" the patrons of a Dublin hotel by tacking on a 10% service charge to tables that weren't meant to pay it has won €8,000 for unfair dismissal.

Devendrasingh 'Ryan’ Boodhun, a bar manager at the Schoolhouse Hotel in Dublin, has been awarded €8,000 for unfair dismissal after being accused of adding a 10% service charge to tables incorrectly. He denied the accusations, stating they were unfounded.

During a hearing at the Workplace Relations Commission (WRC), it was revealed that the hotel's policy was to include a 10% service charge on bills for tables with eight or more patrons, which could be removed if the party objected. Former general manager Geoffrey Cronin testified that staff reported Mr Boodhun for adding tips to bills without customer consent.

Mr Boodhun's representative argued that the accusations were baseless and that the dismissal was procedurally unfair. The WRC adjudicator agreed, ruling in favor of Mr Boodhun and awarding him €8,000 in compensation.

Human resources consultant Sean Stokes testified that Mr Boodhun was aware of the incorrect implementation of the service charge, leading the company to believe he was taking money fraudulently. Despite an appeal process, the decision to dismiss Mr Boodhun was upheld by the hotel's owners.

During the investigation, Mr Boodhun explained that adding a service charge for smaller tables was common in the hospitality industry. However, the company argued that his actions could damage the hotel's reputation.

The adjudicator found that Mr Boodhun's dismissal was procedurally unfair and awarded him €8,000 in compensation under the Unfair Dismissals Act 1977.
